Enclosed are the U.S. Department of Housing and Urban Development (HUD) Office of Inspector General’s (OIG) final results of the audit of the Hammond Housing Authority’s American Recovery and Reinvestment Act Public Housing Capital Fund stimulus formula and competitive grants.

HUD Handbook 2000.06, REV-4, sets specific timeframes for management decisions on recommended corrective actions. For each recommendation without a management decision, please respond and provide status reports in accordance with the HUD Handbook. Please furnish us copies of any correspondence or directives issued because of the audit.

The following weaknesses in internal controls over procurement, suspension and debarment procedures
and noncompliance with procurement, suspension and debarment requirements were noted for NSP:

After properties were purchased with NSP funds, the properties were rehabilitated. Bids were
solicited and received for the rehabilitation services. Change orders were submitted by the Project Manager
and reviewed by the NSP Manager, but were not signed by the Contractor and Redevelopment Commission.

Of the five contracts and change orders tested, two contracts had change orders that exceeded 20 percent of
the original contract. State statutes allow the total of all change orders issued to not exceed 20 percent of the
original contract. No written evidence was provided that the Executive Director approved any of the change
orders. Change orders were not approved by the Redevelopment Commission at a public meeting, as
required by Indiana Statute.



Code:
OMB Circular A-133 Section .300(b) states:
"The auditee shall:
Maintain internal control over Federal programs that provides reasonable assurance that
the auditee is managing Federal awards in compliance with laws, regulations, and the
provisions of contracts or grant agreements that could have a material effect on each of its
Federal programs."

24 CFR 85.36(b) states in part:
"Procurement standards. (1) Grantees and subgrantees will use their own procurement
procedures which reflect applicable State and local laws and regulations, provided that the
procurements conform to applicable Federal law and the standards identified in this section."
Indiana Code 36-1-12-18 states:

"(a) If, in the course of the construction, reconstruction, or repair of a public work project, it
becomes necessary to change or alter the original specifications, a change order may be issued
to add, delete, or change an item or items in the original contract. The change order becomes
an addendum to the contract and must be approved and signed by the board and the
contractor.
(b) If a licensed architect or engineer is assigned to the public work project, the change order
must be prepared by that person.
(c) A change order may not be issued before commencement of the actual construction,
reconstruction, or repairs except in the case of an emergency. In that case, the board must
make a declaration, and the board's minutes must show the nature of the emergency.
(d) The total of all change orders issued that increase the scope of the project may not exceed
twenty percent (20%) of the amount of the original contract. A change order issued as a result
of circumstances that could not have been reasonably foreseen does not increase the scope of
the project.
(e) All change orders must be directly related to the original public work project.
(f) If additional units of materials included in the original contract are needed, the cost of these
units in the change order must be the same as those shown in the original contract."

Planning and Development Department employees working on the NSP grant (NSP Manager or NSP
Specialists) did not verify whether or not the contractors that were awarded bids for the rehabilitation services
were suspended or debarred from federal contracts.
24 CFR 85.35 states in part:

"Subawards to debarred and suspended parties. Grantees and subgrantees must not make any
award or permit any award (subgrant or contract) at any tier to any party that is debarred or
suspended or is otherwise excluded from or ineligible for participation in federal assistance
programs subject to 2 CFR part 2424."



The Hammond Redevelopment Commission adopted Resolution 2-2012 on April 3, 2012, as a
response to the same finding for 2010. The Resolution is a change order policy for federally funded projects
and includes the following wording: "1. All change orders on a federally funded project that exceed twenty
percent of the current approved project budget will be presented before the Commission for approval." This
wording conflicts with Indiana Code 36-1-12-18(d).
Indiana Code 36-1-12-18(d) states:
"The total of all change orders issued that increase the scope of the project may not exceed
twenty percent (20%) of the amount of the original contract. A change order issued as a result
of circumstances that could not have been reasonably foreseen does not increase the scope of
the project."

The following weakness in internal controls over suspension and debarment procedures and
noncompliance with suspension and debarment requirements was noted for CDBG Entitlement Grants:
Written evidence was not provided that the Community Development Planner or Community
Development Finance Manager verified that vendors were not suspended or debarred from
federal transactions when those vendors had payments in excess of $25,000. Some testing for
suspension and debarment was performed by the Community Development Planner but only on
the CDBG public projects. Verification that vendors are not suspended or debarred should also
be performed by the Community Development Planner or by the Community Development
Finance Manager on all subrecipients and payments to vendors with written contracts.

24 CFR 85.35 states in part:
"Subawards to debarred and suspended parties. Grantees and subgrantees must not make any

2 CFR 2424.220 states in part:
"In addition to the contracts covered under 2 CFR 180.220(b) of the OMB guidance, this part
applies to any contract, regardless of tier, that is awarded by a contractor, subcontractor,
supplier, consultant, or its agent or representative in any transaction, if the contract is to be
funded or provided by HUD under a covered nonprocurement transaction and the amount of the
contract is expected to equal or exceed $25,000. This extends the coverage of the HUD
nonprocurement suspension and debarment requirements to all lower tiers of subcontracts
under covered nonprocurement transactions, as permitted under the OMB guidance at 2 CFR
180.220(c)."

The deficiencies in the control over procurement, suspension and debarment are considered a
material weakness.
Failure to follow state and federal procurement guidelines and failure to verify that vendors have not
been debarred or suspended may jeopardize the City's ability to obtain future federal funding.
We recommended that officials establish better controls to ensure compliance with federal and state
guidelines concerning procurement, suspension and debarment and to establish procedures to retain verification
that vendors were not suspended or debarred from federal transactions. We also recommended that
all change orders be approved by the Redevelopment Commission at a public meeting.


Apparently Phill was the point person on this DISBARMENT, costing Hammond Tens of Millions of Dollars in HUD money. Not one word from Tom.

It certainly appears Phill and possibly Lendi were not doing their job... any discipline or discharge? Does losing tens of millions in funding merit either? Absolutely, as if you review several other SBA audits I have done over the years, the last one and possibly two talk about short comings with Hammond's monitoring of federal funds.

Approximately 3 years ago, representatives of HUD came into Hammond and sat down with Tom and company. They basically chewed McDermott another :smt003 out because millions of dollars were unaccounted for as a result of poor bookkeeping...spending lost, un accounted due to the Controller not documenting how funds were spent in pass thru accounts.

Is it because Tom gave Phill the responsibility to assure Tom's pals doing hammond rehab work were not held accountable to the guidelines required by HUD? Was it because Tom wanted to make sure his friends did well with these projects so Tom could get larger campaign contributions? Was there a tie in to one of Tom's family members?

HUD DISBARED Hammond from participating in this program, losing Tens of Millions.... and this is the response Lendi sends to the State Auditors?

Would any small to midsize corporation allow this type of ineptitude?

The question you have to ask your self is why no consequences?

Is it Lendi and Phill have been playing in the pig trough so long, they know where Tom has skeletons?

Three chiefs of staff in less than 1 year.

Mr. Councilman,

Didn't Mayor Thomas McDermott Jr say, on his radio show about 3 weeks ago, how he was afraid to go to jail for what one of his subordinated did? (Was he speaking about Phil? :smt003 )

Didn't Mayor Thomas McDermott Jr also state how, he knows federal agents listen to his show, in fact, I think McDermott said he knows they listen to his radio show, as a fact!

Yes black helicopters are all around hammond, they came visiting in mid december of last year.... sitting down and having a one on two chat with Jr. Why do you think Mr. Chief of staff left?

I wouldn't be surprised if they did bug city hall, like they bugged Cicero's mayor and police departments, resulting in the conviction of Betty Lorin Maltese (spelling). There is sure enough evidence in the state board of accounts reports in themselves to get a conviction.

McDermott's has used city departments to intimidate and harass not only political candidates, but citizens who dare raise concerns over his antics. McDermott has used the city budget to reward those who contribute to his political future, as marginal as it will be.

And Mike, let me make this very clear, McDermott can only give himself credit for putting him in a position where he has to worry about a criminal indictment. No one else put him in this position, just like Cantrell, Pabey, Philpot and a host of others. And you are absolutely correct, I am working to get McDermott this opportunity.

As to stretching a hint of truth.... no more than what you have done using $32,000 of casino money to rent 79 dumpsters one week before the 2011 election, misuse of city tax dollars to assist your political future. HUD Inspector General Reports and State Board of Account Audits must be filled with inaccuracies right Councilman?

As to Hate... no I dislike McDermott for his abuse of power, miss use of city agencies to harasses political opponents, mis appropriation of city money, for his lies, for his antics he used to harass others less fortunate, who don't have the resources to defend themselves.

McDermott has no political future, mostly because of his antics, despite his intellectual limitations and mental health issues, the next administration will put a spotlight on his criminal activity, as the city will be so broke and mismanaged, they will have no other options than point the finger at Jr.

So it is a win win..... :smt002

Did these actions by Mr. Tallon cause Hammond to loose millions in funding? State Auditors presented some of the same questions as the HUD Inspector General wrote resulting in Hammond revocation from their program.

Contractors were making change orders, and they were approved with out RDC board approval. Sorta like the $550,000 which was paid to two contractors with out RDC board approval.

Did these actions or inactions by Mr. Tallon cause HUD Inspector General to initiate an Inspector General Investigation resulting in HUD's suspending Hammond for portions of their program?

& this is a corrective action plan? It looks more line when Indiana's State Board of Accounts requested accounting how McDermott distribution of WoodMar Tiff funds met Tiff guidelines, McDermott refused to answer.

Now why would a public servant, a lawyer, a financial genius like McDermott refuse to answer a State Auditor how disbursed funds were compliant with State/Federal law unless..... :cry:

Hammond's starting to fiscally act like East Chicago during the Pastrick days, where $900,000 in a Park's Department Budget line was transferred to a non existent account and disappeared.

Two years ago Hammond spent $38,000,000 with out city council approval.

Mayor your a lawyer right?

Northwest Indiana rail deals

Officials and companies are saying these rail projects will bring jobs and tax revenues to Northwest Indiana, allowing the region to capitalize on the torrent of freight trains that pass through everyday.

Nov. 1: Potash Corp. and Indiana Harbor Belt Railway announce they will invest a combined $73 million in a transfer facility at Hammond's Gibson Yard. 285 construction jobs and 25 permanent jobs will be created.

Aug. 2, 2011: Canadian National Railway Co. announces it will spend $165 million at Gary's Kirk Yard. The railroad plans to move a locomotive repair shop there as well as expand the existing classification yard, increasing employment at the yeard by 250 people.

June 21, 2011: The LaPorte County Board of Commissioners approve $12 millio in financing to extend a rail line into the Kingsbury Industrial Park while developer Halfwassen Group seeks to round up tenants.

Feb. 6, 2011: Norfolk Southern Railroad inks a deal with Port of Indiana at Burns Harbor to provide all switching services at the port, in a move the port and railroads say will increase business opportunities there.

Feb. 20, 2010: The Federal Railroad Administration announces approval for a $71.4 million project to reconfigure Porter Junction in order to speed Amtrak passenger and freight trains in and out of Chicago. Transportation officials are now hopeful that agreements with railroads can be reached as associated projects in Illinois and Michigan are underway. INDOT estimated the project will create 703 construction jobs.

HAMMOND | Northwest Indiana landed the most recent in a string of rail development projects on Tuesday, with PotashCorp announcing it will locate a major rail transfer facility at Gibson Yard.

"After an extensive search, we decided on Hammond, Ind., because of its location, its railroads and its skilled labor force," said Potash Vice President for Transportation and Distribution Robert Felgenhauer in front of a crowd of smiling city and railroad officials at City Hall.

Potash will spend $64 million on a new 136,000-square-foot transfer facility, with Indiana Harbor Belt Railroad investing $9 million there and the city of Hammond spending $5 million in federal and other funds for demolition and other work.

"A lot of people are fighting for jobs like those that are coming to Hammond, Ind., right now," said Mayor Thomas McDermott Jr., just one week away from election day, when he will make his third bid for the office.

It will take 225 construction workers to build the Potash facility and 60 more for the railroad construction, said Phil Taillon, Hammond director of planning and development. Once the facility is up and running, 25 permanent employees will be needed for the Potash warehouse and on the railroad.

McDermott emphasized the construction jobs will be filled by union workers under local hiring ordinances.

"Some people in Indianapolis have said companies will not locate here because of what they call labor 'aggression' in Northwest Indiana," said Randy Palmeteer, business manager for the Northwestern Indiana Building and Construction Trades Council. "And looked what happened."

Palmeteer was parodying a passage in Gov. Mitch Daniels new book, "Keeping the Republic: Saving America by Trusting Americans," where the governor refers to union "aggression" as a barrier to state's effort to land new jobs for Northwest Indiana.

Potash Corp., of Saskatoon, Canada, is the world's largest fertilizer producer. The company is in the midst of a $7.5 billion expansion of its North American mining operations, Felgenhauer said. The company searched throughout the Midwest for a suitable place to locate a rail transfer facility so it could get product to Eastern markets more efficiently, he said.

After finishing their announcement at the podium, McDermott and Felgenhauer signed the agreement cementing the deal to cheers from city employees, council members and others gathered for the event.

Region officials have long said they want to ink more deals like the Potash one to capture value from the torrent of freight trains that pass through Northwest Indiana every day.

In August, Canadian National Railway Co. announced it would locate a locomotive repair shop and expand its classification yard at Gary's Kirk Yard. The railroad said it planned to invest $165 million in the project and add 250 jobs there.

At Gibson Yard, Indiana Harbor Belt will spend $9 million to build track and facilities to serve Potash, according to Indiana Harbor Belt General Manager Jim Roots. That project includes expanding yard capacity by 1,000 rail cars.

The railroad already has spent $11 million this year expanding its auto transfer yard, which is the largest in the nation, Roots said.

In addition, Hammond's Taillon said the Potash move and expansion of a tax increment financing district there will pave the way for an estimated $130 million more in anticipated development. The city has talked to several interested companies, but Taillon and other officials would not name them.

Infrastructure improvements along the Summer Street corridor will be financed by $16 million in property taxes collected from Potash over the next 20 years, which will be used to pay off tax increment finance bonds, Taillon said. In addition, the Potash project will generate an estimated $3.2 million in tax collections for state and city coffers during the construction phase, he said.

City officials want to demolish the former Glidden Paint factory at Hump Road as part of the project. A Dec. 1 order to repair hearing for its owners may result in the city taking ownership of it, Tallion said.

Was it Phil or McDermott who said there would be 25 long term jobs, one week before the election. Did McDermott do an Oinker like Opie? Or did the write "hear" the information incorrectly?

The actual number now given by this administration is 6 jobs.... and $10,000,000 given to Potash to locate in Hammond. The $10,000,000 was given with out any strings on how it was or should be spent.... nice job Tom!
