Some things never change, Mayor Thomas McDermott Jr acting like a spoiled child again, and Dabertin has learned a lesson about loyalty.

On July 23th, 2015, a FEDERAL appeals court flushed Jr's effort to cancel Hammond's sanitation contract with Griffith, Whiting & Highland, down the drain.....the court in a 2 to 1 decision ruled McDermott acted improperly in 2013 when boy wonder, an attorney, in his own wisdom canceled Hammond's long term contracts treating waste water. The Federal Appeals court ruled the contracts can not be canceled, but require arbitration... something McDermott Jr knows nothing about.

So what does this have to happen with Dabertin? Dabby got a taste of loyalty or is it Dabertin needs to give Jr a larger campaign contribution? :wink: :wink: On Thursday, Dabertin, lost a consulting contract with Hammond. :cry:

Now some might say, about friggin time, but in this case, at least on the surface it is not about cost saving or better government, :roll: its McDermott's way to extract a pound of flesh, with McDermott being upset.... betrayed by Dabertin publicly disclosing confidential communication between them.

The Times quoted the exchange as:

Dabertin disclosed to The Times a series of text messages dated Wednesday afternoon between him and McDermott.

Dabertin complained, "What's going on? .....Fest is not a city of Whiting event Tom; we pay for Whiting services just like we pay for Hammond cops; why are we getting pulled into this fight?"

The mayor replied, "Tom, until the litigation is completed between our cities, Hammond will not participate at all in Whiting events. We wish them well, and the WR COC as well. But Hammond city employees will not participate in (Perogi Fest). Sorry we've been in expensive litigation for two years, and I think Hammond's position is very reasonable. We've always supported Whiting and have been a good neighbor, that's why it's so hard for me to understand Joe's militant stance. I have no other option."

Dabertin said he warned McDermott he would "look very bad" targeting the Whiting [b]Robertsdale Chamber of Commerce noted in the text, a private organization represented by Marissa McDermott, the mayor's wife. The mayor said it was inappropriate to bring his wife into this dispute. Dabertin said he only meant to remind McDermott of the previous good relationship between the festival and the mayor.

Ok so it appears Jr lost a court battle and he kicks the nearest dog, Dabertin and Pirogi Fest, ending Dabertin's contract, not because of good government, cost cutting, but because of a Federal Appeals Court ruling regarding contract law, what any first year law student would know... you can't cancel a contract.

So, Hammond won't supply 20 off duty cops, and the inappropriate use of 40 College Bound interns.... if something goes down at the fest, how much responsibility will Jr have?

So, its a loose loose proposition. Hammond Cops and interns lose a couple of extra sheckles and the Pirogi Fest goes on with out extra public safety..... all because of a spoiled child.

When is Mr. Capp going to act on the indictment sitting on his desk?

Dabertin replied, texting that McDermott is "screwing over an independent organization that has nothing to do with the fight."

"We pay for all the services from Whiting, Tom. Why screw us?" Dabertin said, adding that the chamber has no time to secure other departments because "it takes months to plan an event."

McDermott said he apologized if Dabertin felt "this is somehow personal towards (sic) you."


Dabertin said in a susequent text that the mayor's refusal to help "will look very bad that (McDermott) targeted a private organization that (McDermott's wife, Marissa McDermott) represents," but that other mayors have pledged to support the festival.

"I'm not going to provide manpower to a Whiting event Tom, that's what this is all about," McDermott said.

"It's not and you know it," Dabertin countered. "In fact, (Whiting Mayor Joe) Stahura just called and said the same thing – it doesn't hurt him but it does the chamber."

Yea, if it wasn't personal, Dabertin would still have the contract.

Is this enough to turn north hammond against jr in the november election?

Does Dabby have enough insight on McDermott's vices and misdeeds to burn Jr? You bet.

I'm not sure why McDermott thinks these texts or the other conversations between him and the consultant are confidential. He looks at these conversations and likens them to what a client might discuss with his attorney on matters concerning litigation. Since that is not the case, no legal nor even ethical duty is required to keep these texts private. Acting as a elected public official, more transparency and less cloak and dagger would positively impact government. It is troubling to hear McDermott unwittingly admit that he expects by "paying someone hundreds of thousands of dollars" in public money, the consultant has a personal responsibility to him and not to taxpayers.

The mayor acted like a spoiled little kid who couldn't get their way, so he ruined the day for everyone. :evil:
