Teen to stand trial next spring in Lew Wallace teacher's slaying

A Lake Criminal Court judge has scheduled a trial next spring for a Merrillville teenager charged with killing an 80-year-old Gary high school teacher.

Jurors will hear evidence the week of April 9, 2012, on whether 16-year-old Royal Marshall robbed and killed Anna Schulz of Merrillville last summer.

Marshall appeared Monday morning before Judge Salvador Vasquez. Schererville defense lawyer, Eric Clark, said he asked for Marshall's case to be decided at trial.

Marshall is pleading innocent to the allegation he murdered the victim with a sharp-edged weapon July 6 in an attack at her home in the 2500 block of West 58th Place in Merrillville. He also is charged with stealing Schulz's Cadillac DeVille.

Police allege Marshall entered the victim home while fleeing officers investigating an earlier burglary reported in the 6400 block of Taft Street.

Schulz had been a teacher for more than 30 years. She was teaching special education to students with mild disabilities at Lew Wallace High School at the time of her death.

CROWN POINT | A Merrillville teen pleaded guilty Friday to an amended charge of voluntary manslaughter in the July slaying of an 80-year-old Gary high school teacher.

Royal Marshall, 17, will be sentenced to 30 years in prison if Lake Superior Court Judge Salvador Vasquez accepts his plea agreement. In exchange for Marshall's plea, prosecutors agreed to dismiss charges of murder, murder in the perpetration of a robbery, robbery and auto theft.

During the hearing, Vasquez read from a probable cause affidavit describing the events July 6 that led to the killing of Anna Schulz, a Lew Wallace High School teacher, in her Merrillville home.

Marshall affirmed the following account read by Vasquez:

Marshall fled from police after a possible burglary was reported in the 6400 block of Taft Street.

He saw a house with an open door in the 2500 block of West 58th Place and attempted to hide there. He startled Schulz while inside her home, grabbed a knife and cut her neck.

Schulz's Cadillac was missing when she was found dead in her home. Police recovered the vehicle in an alley behind the home of a relative of Marshall's. A pair of women's shoes that appeared to have blood on them was located in the car.

Police searched for the murder weapon in a pond behind Schulz's home, but nothing was recovered.

Vasquez said the plea agreement can't be changed after he accepts it. He told Marshall not to "waste your time or my time" by sending letters asking Vasquez to modify the agreement.

A sentencing hearing is set for June 28.

CROWN POINT | Defense attorney Eric Clark said his 17-year-old client always wanted to accept responsibility and receive his punishment for the July 2011 slaying of an 80-year-old Merrillville woman.

The punishment for Royal Marshall, of Merrillville, came Thursday as a 30-year prison sentence. Marshall will receive credit for the 358 days he already has served in prison.

Last month, Marshall pleaded guilty to voluntary manslaughter.

Lake Superior Court Judge Salvador Vasquez accepted a plea agreement Thursday, which dismisses charges of murder, murder in the perpetration of a robbery, robbery and auto theft.

During the May hearing, Marshall affirmed the events that led to the July 6 killing of Anna Schulz, a Gary high school teacher, in her home.

When Vasquez first asked Marshall on Thursday if he wanted to comment about the situation, Marshall told him he had nothing to say.

Although Marshall didn't speak initially, Clark said his client is sorrowful.

"There's no sorrow there," Vasquez said.

He said it's rare to have a defendant seeking a plea agreement to "say nothing at all," and he wasn't pleased to see Marshall with "no expression."

Vasquez advised Marshall that he didn't have to accept the agreement and the case could have gone to trial. If Marshall was convicted of the crimes, he would have faced 45 to 65 years in prison, he said.

Marshall later commented when Vasquez again asked if he wanted to speak.

With his head down, he quietly apologized to Schulz's family and said "what I did was wrong."

"I just want to say I'm sorry," Marshall said.

Clark said Marshall isn't good at expressing himself, but he believes his client is remorseful.

He said from "day one" Marshall wanted to plead guilty.

Vasquez said the case was a difficult one to assess. He said there was circumstantial evidence, but no DNA or fingerprints linking Marshall to the crime scene.

Police searched for a murder weapon, but nothing was recovered.

Vasquez advised Marshall that it would be a waste of time to send him letters asking him to modify the agreement. Vasquez told him the sentence "will never be changed."

So basically he'll be out and hunting the streets of NWI by about the age of 32.
