VALPARAISO | Joe Carnell hesitated at first when asked Wednesday morning if he saw Ashley Toney light a piece of paper on fire before it was thrown out the window of their Portage school bus on Feb. 3, 2009.

"It's quite possible," he said.

When pushed further by Deputy Prosecutor Tim Haraminac, Carnell finally confirmed he saw the act that has resulted in a misdemeanor count of criminal recklessness against Toney.

Public Defender Dolores Aylesworth, who is representing Toney, pointed out a short time later that Carnell told attorneys earlier this summer he never saw Toney light anything on fire on the day in question.

Carnell testified he did not remember a thing about the June 15 deposition in question.

Ashley Toney, 18, faces three felony counts of sexual battery,
felony criminal confinement, two misdemeanor counts of public
indecency and misdemeanor charges of criminal recklessness
and disorderly conduct connected to incidents from late 2008
to early 2009 on a Portage High School bus.

Another student from the bus, Rubin Thomas, testified he saw Toney twice brush the breast of a female student, despite her objections.

Females from the bus testified Tuesday that Toney had touched their breasts and/or buttocks without permission, resulting in three felony sexual battery charges.

Thomas also said he saw Toney expose his own buttocks and chest. He was charged with a misdemeanor count of public indecency.

Toney also faces a felony criminal confinement charge for refusing to lift his legs and let a female student leave the bus.

I wondered the exact same thing myself.
On a side note, I had to laugh how things never change. The gay guy60438, who goes by the name Progressive on the Times board, is crying the blues that the posters he gets banned over there keep reappearing as other posters. The offenses of the banned posters? They don't like McDermott..who 60438 finds to be a very handsome man he would LOVE to get on his knees for.
