Two investment companies stand to receive hundreds of millions of dollars in tax breaks under a bankruptcy exit plan for failed solar company Solyndra, government lawyers say.

Nearly a year to the day after the solar company filed for bankruptcy owing taxpayers more than $500 million, Solyndra is poised to restructure under a deal that government lawyers fear could provide a tax windfall to the investors.

The investment companies, Argonaut Ventures and Madrone Capital Partners, may be able to use net operating losses at Solyndra to avoid “hundreds of millions of dollars in future income taxes” unrelated to the solar company, according to a recent court filing by government lawyers.

In addition to earlier financing, both companies provided $75 million to Solyndra last year in a controversial restructuring deal approved by the Department of Energy (DOE) that allowed the financiers to be paid back before taxpayers in case of a default.

Taxpayers are expected to receive little of the $528 million that Solyndra still owes the government, but DOE officials have defended the restructuring, saying it was the best chance of keeping Solyndra in business.

The Obama campaign rolled out the red carpet this week for a former top Energy Department official who was at the center of the ill-fated government loan to Solyndra, a California solar panel firm that wound up in bankruptcy.

Steven J. Spinner joined other top fundraisers for a VIP tour of the Democratic National Convention floor in Charlotte Monday evening, posing and waving for a photographer while standing behind the podium. When he saw ABC News cameras, however, he ran for the exit.

Spinner was last in the headlines in October, when emails surfaced showing he had pushed for the Solyndra loan from his post in the Energy Department, apparently in an effort to score the loan as a political victory for President Obama.

Bankrupt solar panel maker Solyndra said Friday it could get $23 million in additional tax breaks, a development that angered Republicans who have said the firm got a federal loan guarantee as a political favor.

Reuters reported that a bankruptcy judge said on Friday that Solyndra’s creditors could vote on the bankruptcy plan with the additional tax breaks. A final decision would come Oct. 17 -- just weeks before the Nov. 6 election.

Solyndra already had disclosed it could be eligible for $341 million-worth of tax breaks.

The revelation that more tax breaks could be in the offing bought charges from Republicans that the loan guarantee to Solyndra, whose venture capital backer had ties to the Obama administration, was spoils for support.

“One year after Solyndra filed for bankruptcy, we continue to learn the ugly truth of Solyndra’s sweetheart restructuring deal,” House Energy and Commerce Chairman Fred Upton (R-Mich.) and subcommittee on Oversight and Investigations Chairman Cliff Stearns (R-Fla.) said in a Friday statement to The Hill.

The Internal Revenue Service plans to dispute the bankruptcy plan, Reuters noted.

E-mails released by the White House last week showed that Heather Zichal, an energy aide to President Barack Obama, relayed the news about the Fremont-based solar firm’s planned layoffs to top White House officials, including Communications Director Dan Pfeiffer and senior adviser Valerie Jarrett and Vice Presidential Chief of Staff Ron Klain.
