Company That Built Train Wreck Obamacare Website Awarded 6 Additional Contracts By CMS After Disastrous Launch

According to a company spokesman, CGI Federal was awarded six additional contracts from CMS worth approximately $37 million between October 1 — when the over $600 million Obamacare website launched — through January 2014.

CGI Federal is the U.S. arm of the Canadian company CGI Group, and was formed in 2009 to bring CGI into the federal contracting business. The company employs Michelle Obama’s Princeton classmate, and 2010 White House Christmas guest, Toni T0wnes-Whitley as a top executive.

CGI, which received the Obamacare website contract in Obama’s first term, was fired from its role as prime contractor on the website in January.

Health Insurance Company Humana Says It Will Ask Government For As Much As A $450 Million Bailout To Cover Obamacare Costs

There’s been a lot of discussion about whether the risk adjustment tools embedded in ObamaCare amount to a bailout for the insurance companies, or are a reasonable feature of the law. There’s been far less information about how much money the insurers stand to gain from these measures, to offset their expected losses.

Now we have some hard numbers. Humana announced that it expects to tap the three risk adjustment mechanisms in ObamaCare for between $250 and $450 million in 2014. This amounts to about 25 percent of the insurer’s expected exchange revenue. This money is needed to offset losses that the insurer will take as a result of slower enrollment in its ObamaCare plans, and a skewed risk pool that weighs more heavily toward older and less healthy members than it originally budgeted.

More than half of the money will come from the $25 billion reinsurance pool that ObamaCare provides (collected through a tax on employer-sponsored health plans). The other half will come mostly from the risk corridors. Humana is expected to book the money as revenue to offset shortfalls between what it collects in exchange premiums and pays out in medical claims.

The company blamed the Obama Administration’s decision late last year to extend grandfathering of individual market plans for the overall deterioration in the risk pool. That means that Humana (like other insurers) was counting on people from the individual market being forced to transition into ObamaCare plans. It’s widely perceived that the Obama Administration counted on that migration as well. But Humana’s statement was a very clear expression of this expectation.

Humana said that it had enrolled 202,000 people on its exchange-based health plans as of January 31st, of which 82 percent were eligible for subsidies.

Florida Senator Marco Rubio has been particularly vocal about his desire to repeal the piece of the law known as risk corridors, and fellow Republicans reportedly want to make it a condition for raising the debt ceiling.

That position just got a little less sensical now that congressional bean counters think the program will actually be a net gain for the U.S. Treasury. In other words, a potential Republican gambit over the nation’s borrowing limit would, if successful, repeal a law expected to actually reduce deficits by $8 billion over the next three years.

Some background: Risk corridors are one of the obscure pieces of the Affordable Care Act intended to stabilize insurance markets as millions of previously uninsured customers enter the system. The provision lasts three years and applies only to companies offering plans on healthcare.gov and state-run exchanges. If those insurers pay out much more in medical claims than they anticipated when setting premiums, the government will backstop some of their losses.

That’s why critics call it a bailout, even though the government offers insurers similar protection from catastrophic risks such as floods and terrorism. But if insurers set rates too high and pay out much less in medical claims than they expected, they will have to pay some of that money back to the government.

This changes insurers’ incentives in important ways. First, it encourages them to offer plans in the exchanges, knowing that their losses will be limited if the people they enroll turn out to be much costlier—i.e., sicker—than anticipated. It also gives them an incentive to be on the safe side and not price premiums too high. And it removes insurers’ incentives to recruit only the healthiest people. With losses and gains evened out after claims are settled, they have little to gain by trying to shun costly patients with chronic conditions like cancer or HIV. Actuaries like predictability, and the risk corridors inject a big dose of it into what’s otherwise a highly uncertain new market.

The Congressional Budget Office, the legislature’s nonpartisan arbiter of how new laws will affect the nation’s fiscal outlook, originally considered the risk corridor program a wash likely to collect as much as it pays out. A new budget outlook (PDF) published Tuesday, however, estimates the provision will cause a net gain of $8 billion over three years.

Story: Obamacare's Medicare Experiment Is Working

Why did the CBO change its estimate? Partly because it took a close look at a similar risk corridor program in the Medicare drug benefit known as Part D—and that one had been saving the government money: “Under Part D’s risk corridors, collections from insurers have exceeded payments to insurers, yielding net collections that have averaged about $1 billion per year—between 2 percent and 3 percent of total covered costs for drugs under Part D,” today’s report says. In other words, without the existing risk corridors in that program, Medicare’s prescription drug costs would go up by a couple of percentage points.

It’s theoretically possible that only really sick people will sign up for coverage in the exchanges, and insurers will wildly low-ball their premiums. That scenario would cost the government billions in Rubio’s bailout scenario. As the CBO acknowledges, “The government has only limited experience with this type of program, and there are many uncertainties about how the market for health insurance will function under the ACA.”

But more likely the program will help stabilize the new marketplaces and may even net the government a few billion bucks. For a “bailout,” you could do a lot worse.

“Pro-Obamacare ads are like an endangered species, like seeing a unicorn or the Loch Ness monster,” said Elizabeth Wilner, Kantar Media senior vice president for political advertising. “Democrats are either not talking about it at all or talking about it needing to be fixed.”

Obama’s Unilateral Decision To Delay Obamacare’s Employer Mandate Violates Plain Language of The Law

President Barack Obama’s Treasury Department issued a new regulation today that for the second time directly violates the plain and unambiguous text of the Patient Protection and Affordable Care Act by allowing some businesses to avoid the law’s Dec. 31, 2013 deadline to provide health insurance coverage to their employees.

Initially, on July 2, 2013, the administration unilaterally delayed the deadline for the employer mandate until 2015. Now, the administration is unilaterally delaying it for some businesses until 2016.

In its official summary of PPACA, the Congressional Research Service said: “(Sec. 1513, as modified by section 10106) Imposes fines on large employers (employers with more than 50 full-time employees) who fail to offer their full-time employees the opportunity to enroll in minimum essential coverage or who have a waiting period for enrollment of more than 60 days.”

The text of the law itself describes an “applicable large employer” as follows: “The term ‘applicable large employer’ means, with respect to a calendar year, an employer who employed an average of at least 50 full-time employees on business days during the preceding calendar year.”

The final words in the section of PPACA mandating that employers with more than 50 full-time employees provide their employees with “minimum essential coverage” imposes a specific statutory deadline for doing so. It says: “EFFECTIVE DATE.—The amendments made by this section shall apply to months beginning after December 31, 2013.”

But hey, in the eyes of Harry Reid, those mean old Republicans are telling everyone who will listen that ObamaCare is “bad.” Bad? Is he tweeting to 2nd graders, or what?

Obama Quietly Increases Bailout Money Insurance Companies Will Receive For Losses Sustained Because of Obamacare

In typical shady fashion, they changed the rule late Friday afternoon to avoid this making the news.

In a sneaky and illegal maneuver after close of business Friday, the Obama administration proposed a new rule increasing bailout protection for insurance companies that sell ObamaCare exchange plans. The rule –using taxpayer money, of course — is designed to protect the companies from losses.

It’s illegal, because no president, including Obama, has the constitutional authority to rewrite the laws. The president’s sworn duty is to “take care that laws are faithfully executed.”

The Affordable Care Act, as written and enacted in 2010, contains a bailout provision, Section 1342. It makes insurers whole for losses they were certain to incur by virtue of offering “affordable” plans.

Such losses were inevitable, because ObamaCare rules make it impossible for an insurance company to offer “affordable” plans and still cover costs. The premiums have to cover a long list of mandatory benefits, as well as $100 billion in taxes that the law imposes on insurers over the decade. Most significantly, the premiums have to cover the cost of caring for seriously ill people for the same price as healthy people.

Every state that tried this community rating scheme (including New York ) has seen premiums soar as the healthy, unwilling to foot the bill, stop buying insurance.

The bailout provision was inserted in the law by design to encourage insurers to set premiums too low. That helps the law, and its Democratic backers, look good. It was deception from the start, and a real effort to make a fatally flawed scheme appear as if it is providing affordable health plans.

Poll: Support For Obamacare Among Hispanics Craters, Falls From 61% Down To 47%
